P&G and Colgate-Palmolive Face Complaints on Kids\' Toothpastes


Procter & Gamble and Colgate-Palmolive are faced with six class action complaints regarding toothpaste and mouth rinse for young kids. 
 
The companies are accused of deceptively marketing products to parents, misleading them into believing that fluoride-containing toothpaste and mouth rinses were safe for toddlers and young children. 
 
According to the complaints, product labels depicted candy, fruit juice flavors, and cartoon characters to attract young kids. 
 

The complaints accuse P&G and Colgate-Palmolive of failing to adequately flag instructions for proper use, as mandated by the US Food and Drug Administration (FDA).
 

Toothpastes that are targeted include P&G’s Kids Crest Fluoride Anticavity Toothpaste, and toothpaste sold under Colgate-Palmolive’s Colgate and Tom’s of Maine brands.
 
Accused mouth rinse products included ones from Colgate’s brands, Perigo’s Firefly brand, Chattem’s ACT Rinse, and ones from the Hello oral care label.
 
Complaints were filed in federal courts in California and Illinois. 
 
The lawsuits seek restitution, compensatory damages, and triple or punitive damages for the violations of various consumer protection laws.
